BASIC PAYMENT SCHEME (BPS)
The land is registered on the Rural Land Register and has been used to activate Basic Farm Payment entitlements. The Basic Farm Payment Entitlements are not included in the sale but may be available to purchase from the outgoing tenant by separate negotiation.
The outgoing tenant has made the claim for the 2021 BPS which will be retained, and the purchaser will indemnify the outgoing tenant for any breaches of the cross-compliance rules until 31st Dec 2021.

OVERAGE PROVISION
The land will be sold subject to an overage clause whereby the Vendor or their Successors in Title will receive 30% of any uplift in value arising as a result of obtaining any planning consent for a change of use from agriculture or domestic equestrian grazing use for a period of 80 years from the completion of contracts. The Vendor may consider alternatives to this provision but any offer made must clearly set out an alternative to this provision and detail the proposed change of use.
